Statutes Of Limitations On Sex Crimes

All states have statutes of limitations for filing civil suits after an injury or crime. While it is possible that missing these deadlines may prevent you from filing a suit, there are multiple exceptions to these rules. In some cases, we are able to file suits after the statute of limitations has passed.

If you are considering a civil suit in a sexual abuse or assault case, you should speak with an attorney as soon as possible. At Soloff & Zervanos, P.C., we can explain your rights and determine whether your case is an exception to the statute of limitations. You can rely on our trial skill and experience if we file a case on your behalf.

Attorney Jeffrey Fritz will help you pursue appropriate legal action with confidence. Mr. Fritz is a charter member and past president of the National Crime Victim Bar Association, an affiliate of the National Center for Victims of Crime. He knows exactly how to obtain the full and fair compensation you need to achieve justice.

Statutes Of Limitations On Sexual Crimes In Pennsylvania And New Jersey

There are bills pending in Pennsylvania and New Jersey regarding changing the statutes of limitations for filing civil suits after a crime. For the most current information, please call us.

In Pennsylvania, a person who has suffered child sexual abuse typically has until age 30 to file a civil suit against the liable parties. For adult rape or sexual assault civil suits, a person has two years from the date of injury to file. You have until age 50 to file criminal charges against the offender.

Effective December 1, 2019, in New Jersey, victims will have two years to file a civil in a child sex abuse case regardless of when the abuse occurred. After December 1, 2021, victims will have until age 55 to file a lawsuit for child sexual abuse or within seven years from when the victim becomes aware of the injury caused by the abuse. There are many exceptions to this statute, however. Only an experienced crime victim’s attorney can tell you whether the statute applies in your case. For adult rape or sexual assault civil suits, a person has two years from the date of injury to file.

If the abuse took place in more than one state, talk to an attorney right away because the laws are different in every state.
